The community property is the supplementary matrimonial property regime in common law.
This regime will begin at the time of the celebration of the marriage or later, when agreed upon in marriage contracts.
Property acquired before the marriage or received free of charge during the marriage will be the exclusive property of each of the spouses. In this way, there will be a private patrimony for each spouse and a marital or common patrimony.
The "contribution to the community property" consists of transferring an asset from the private property of one of the spouses to the community property of both, by virtue of the freedom of contract between spouses.
Required documentation:
- Property titles of the spouse who provides the assets.
- ID of both spouses.
- In the case of urban properties, certificate from the community of owners that proves that they are up to date with the payment of community expenses.
- Cadastral reference (last IBI receipt).
- Information on whether the properties are leased.
- Value of the contribution.
